ISLAMABAD (RNN TV) — On Wednesday, the Supreme Court rejected the Punjab government’s request for the physical remand of Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan.
A three-member bench, led by Justice Hashim Kakar, heard the case. The Punjab government’s lawyer argued that physical remand was essential for conducting tests such as photogrammetric analysis, polygraph testing, and voice matching.
Justice Kakar observed that the appeals were solely for Imran Khan’s physical remand and questioned why the Punjab government was seeking it after a delay of one and a half years. He added that at this stage, there was no valid justification for granting the request.
The special prosecutor stated that the PTI leader was not cooperating with the investigating team. However, Justice Kakar responded by questioning what kind of cooperation could be expected from an accused person already incarcerated. He suggested that any tests could be conducted with permission from a trial court.
The prosecutor also mentioned that the investigating team visited Imran Khan in jail on July 14, 2024, but he refused to cooperate. He referred to messages from the PTI leader on Facebook, Twitter, and Instagram, threatening protests if he was arrested.
Justice Salah Uddin Panhwar responded, suggesting that if these messages were stored on a USB device, forensic testing could be done. He pointed out that such tests are not typically conducted in ordinary murder cases, questioning why the police were not equally active in those cases.
Justice Kakar cautioned that any observations made by the court could impact the ongoing trial.
Ultimately, the court dismissed two appeals from the Punjab government seeking Imran Khan’s physical remand. It stated that the prosecution could approach the trial court for permission to conduct the polygraph, photogrammetric, and voice matching tests. The court also noted that Imran Khan’s legal team could raise objections to the request in the trial court.
